Auszüge aus den internationalen und nationalen Vorschriften bei Abschiebungen per Flugzeug (geschickt von der Austrian Cockpit Association am 31.5.01)
Internationale Rechtsgrundlagen
Im Zusammenhang mit Fragen der Abschiebung von Personen auf dem Luftweg existieren Regeln, Empfehlungen und Richtlinien in den unten zitierten Dokumenten.
Kurz zusammengefasst wird geregelt:
- die Informationsverpflichtung der Behörden an die Fluglinien und der verantwortlichen Piloten (vgl Annex17, 4.2.3, Annex 9, 3.52
- die Informationsverpflichtung der Behörden an entsprechende Behörden der Transit- und Bestimmungsländer (vgl. Annex 9, 3.53)
- die Verpflichtung der Fluglinien geeignete Sicherheitsvorkehrungen zu treffen (vgl. Annex 17, 4.2.3, JAR OPS 1.265)
- die Rechte und Pflichten des verantwortlichen Piloten in Bezug auf die Letzverantwortung für Sicherheit (und Ordnung und Disziplin) an Bord und dem Recht auf Setzen von Zwangsmaßnahmen (vgl Tokyo Convention, Artikel 6, JAR OPS 1.085).
ICAO Annex 17
4.2.3 Each Contracting State shall establish measures to ensure that the aircraft operator and the pilot-in-command are informed when passengers are obliged to travel because they have been the subject of judicial or administrative proceedings, in order that appropriate security measures can be taken.
ICAO Annex 9
3.52 Each Contracting State shall ensure that the operators concerned are informed when persons are obliged to travel because they have been formally ordered by the public authorities to be removed from that State. The public authorities shall inform the operators in sufficient time so that the operators can take precautions to ensure the security of the flight.
Note. - The following information is to be provided, subject to national privacy legislation, to the operators by the public authorities:
- name of person to be identified as deportee;
- reason for deportation:
- names of escorts/guards;
- willingness or unwillingness to travel; and
- any other information that would allow the operators to assess the risk of endangering the security of the flight
In order to ensure appropriate co-ordination of facilitation and security specifications, attention is drawn to the applicable provisions of Annex 17, Chapter 4.
3.53 Each Contracting State shall ensure that the public authorities ordering the deportation inform the public authorities of transit and, if advisable, those of destination countries of the planned transport
JAR-OPS
JAR-OPS 1.265 - Carriage of Inadmissible Passengers, Deportees or Persons in Custody
An operator shall establish procedures for the transportation of inadmissible passengers, deportees or persons in custody to ensure the safety of the aeroplane and its occupants. The commander must be notified when the above-mentioned persons are to be carried on board.
JAR-OPS 1.085 - Crew Responsibilities
(e)] The commander shall:
(5) Have the right to refuse transportation of inadmissible passengers, deportees or persons in custody if their carriage poses any risk to the safety of the aeroplane or its occupants;

Kapitel III - Befugnisse des Luftfahrzeugkommanadanten
Artikel 6 (maßnahmen)
(1) Hat der Luftfahrzeugkommandant ausreichende Gründe für die Annahme, dass eine Person an Bord des Luftfahrzeuges eine stafbare oder andere Handlung nach Artikel 1 Absatz 1 begangen hat oder zu begehen im Begriff ist, so kann er gegenüber dieser Person angemessene maßnahmen, einschließlich Zwangsmaßnahmen, treffen, die notwendig sind,
a) um die Sicherheit des Luftfahrzeuges oder der Personen oder Sachen an Bord zu gewährleisten;
b) um die Ordnung und Disziplin an Bord aufrechtzuerhalten;
c) um es ihm zu ermöglichen, diese Person zuständigen Behörden zu übergeben oder sie in übereinstimmung mit den Bestimmungen dieses Kapitels abzusetzen
(2) Der Luftfahrzeugkommandant kann von anderen Besatzungsmitgliedern verlangen oder sie ermächtigen sowie FlugGäste auffordern oder ermächtigen, jedoch nicht von ihnen verlangen, ihn bei Zwangsmaßnahmen gegen eine Person, der gegenüber er hiezu befugt ist, zu unterstützen. [...]
Flight Operations Manual:
Hier die Auszüge aus den Regelungen der Österreichischen Airlines basierend auf den internationalen Vorschriften:
Airlines do not actively seek deportee traffic. Deportees will be accepted for carriage only:
on order of the competent Austrian authority;
on request of a foreign authority, if the reason for extradition is:
o lack of working permit,
o illegal entry,
o expired visa,
o cancelled or invalid permit of residence,
o insufficient funds,
o repatriation.
Deportees which need to be foot-manacled or gagged (e.g. with adhesive plaster over the mouth to hinder speaking) may not be accepted. In any case the Commander has the final authority to refuse a deportee / inadmissible passenger.
