01 Klagenfurt/Celovec: "Schillerparkkonzert" vor dem Aus?

Und weiter geht er, der kulturpolitische Kahlschlag in
Kärnten/Koroska. Nach Tanzthaeter Ikarus, Unikum, Radio Agora und
vielen anderen erwischte es diesmal eine Veranstaltung, von der
niemand gedacht hätte, dass sie so frontal angegriffen wird. Es geht
hier um das (mittlerweile schon "legendäre" und für Klagenfurts
alternative Jugendszene jedes Jahr heiß herbeigesehnte) Konzert im
Schillerpark, bzw. "Schillerparkkonzert".
Die Klagenfurter Stadtregierung legt es diesmal nämlich darauf an,
das Konzert unter keinen Umständen stattfinden zu lassen. Nachdem die
VeranstalterInnen letztes Jahr schon einige Probleme mit den Behörden
hatten und das Konzi erst 2-3 Tage zuvor behördlich genehmigt wurde,
kontert der Stadtsenat diesmal sogar mit "Argumenten". Zum einen wäre
da die angebliche "Lärmbelastung" - doch dass rund um den
Schillerpark kaum Leute wohnen, sich diese in all den Jahren zuvor
noch nie beschwert haben und das Konzert noch dazu am frühen Abend
endet, all das hat der Stadtsenat in seiner Argumentationsfreudigkeit
unter den Tisch fallen lassen. Ein weiteres "Problem" soll laut
Gesundheitsreferentin Maria-Luise Mathiaschit (SPÖ) der Konsum von
Alkohol und Drogen bei diesem Konzert sein, noch dazu, da es sich um
ein "Anti-Drogen-Konzert" handle (mehr dazu weiter unten im Text).
Stadtrat Christian Scheider (FPÖ - sieht sich gerne als Retter der
Jugendkulturszene) schlug daraufhin vor, das ganze Spektakel doch
ganz einfach in den Europapark (neben dem Wörthersee) zu verlegen.
Was das heissen würde? Punx/MetallerInnen/HipHopperInnen und alles
was sonst noch irgendwie in ein kulturell "alternatives" Spektrum
fällt würden somit an den Stadtrand gedrängt. Noch dazu ist zu hören,
dass das Konzert in "grössesem Rahmen" organisiert werden soll. Den
kulturpolitischen Vorstellungen der FPÖ nach zu urteilen hat das
dann was mit der in Kärnten/Koroska gehegten "Eventkultur" zu tun.
Die Folgen sind Entpolitisierung und Kommerzialisierung von
Kulturprojekten.
Was das Verbot oder die Verlegung des Schillerparkkonzertes für die
junge Klagenfurter alternative Szene konkret heissen würde?
Zuersteinmal natürlich das Nicht-Stattfinden eines tollen
Party-Nachmittages unter freiem Himmel, wo sich viele neue und ältere
Bands hauptsächlich aus Kärnten/Koroska präsentieren können. In
weiterer Folge aber hiesse es, dass jegliches alternative
Kulturkonzept erfolgreich aus der Stadt verdrängt wird - in diesem
Falle wegen zB. wegen des "Lärms". Dabei ist es gerade die Aufgabe
von kritischer alternativkultur zu "Lärmen". Aufzuzeigen gegen
gesellschaftliche Misstände. Gerade in Kärnten, wo die rechtsextremen
Verbände "Kärntner Abwehrkämpferbund" und "Kärntner Heimatdienst"
seit letztem Jahr mit Millionenbeträgen subventioniert werden,
Unterstützung für freie Kulturschaffende aber sukksezzive abgebaut
wird (mittlerweile hat sich diese Förderpolitik sogar schon auf die
"alternative" Waldorf-Schule ausgeweitet, die in akuten Geldnöten
steckt). Alles passt in Scheiders "Stadtmarketing"-Konzept. Eine
Saubere Stadt mit Sauberen BürgerInnen. Brav. Ja-Sagend. "Echt
kärntnerisch".
Doch von wem ging die Organisation des Schillerparkkonzerts in den
letzten Jahren eigentlich aus? Vom Stadtsenat auf keinen fall,
sondern von Klagenfurts "Streetworkern" Offiziell zwar eine
Magistratsabteilung, (bezeichnen sich aber ungern so) kümmert sich
eine Gruppe SozialarbeiterInnen um Menschen, die in der
Konsumgesellschaft als "Problematisch" gelten. Obdachlose,
Drogenabhängige, Ex-Häftlinge und andere Personen, die von der
Kernschicht der FPÖVP-WählerInnen gerne mal als "Gesindel" bezeichnet
werden. Dass Drogenkonsum bei einer Veranstaltung für sozial
vernachlässigte Gruppen (seien dies nun Obdachlose oder eben Punx)
nichts unübliches ist, wissen die VeranstalerInnen. Und wollen dies
auch niemandem verbieten (eher schon die Polizei, die letztes Jahr
durch den Park patroullierte und mit Zivis anwesend war). Es geht
darum, den erwähnten marginalisierten Gruppen Platz zu bieten für
ihre Kultur und die Botschaften, die mit damit verlautbart werden.
Und diese Botschaften richten sich eben gegen "Stadtmarketing",
"Eventkultur" und ähnliche Auswüchse und werden in den letzten jahren
(besonders seit dem Amtsantritt Haiders als Landeshauptmann) immer
wieder Schikanen und Verboten ausgesetzt.
Bisher herrscht in der Klagenfurter Jugendszene eher Ratlosigkeit und
Ernüchterung - Widerstand zu leisten ist bisher nicht drin, viele
haben sich mit der jetzigen Situation sogar schon abgefunden. Ausser
einer Unterschriftenaktion (die augenscheinlich nicht allzu
erfolgreich verlaufen ist) gabs bisher doch wirklich kaum Widerstand.
In den letzten Jahren wurden doch schon so viele Projekte
ausgehungert bzw. waren vor dem Ende. Die Entpolitisierung der
alternativen Szene schreitet derweil voran...
Als Einzelperson bitte ich deswegen alle Menschen, die sich mit der
Herrschenden Situation aktiv auseinandersetzen wollen mir eine Mail
an koroskiodpor@yahoo. de zu schreiben, damit wir eventuell eine
Demonstration organisieren könnten. Das "Gesindel" lässt sich nämlich
nicht so leicht aus dem öffentlichen Leben vertreiben, da es genau
dort seinen Platz hat: in der Mitte der Gesellschaft. Auch wenn es
Scheider, Haider und viele andere Kärntner "Eliten" nicht so haben
wollen.
Der Schillerpark gehört uns. Und wenn wir ihn nicht bekommen, dann
nehmen wir ihn uns halt...

Am VolksstimmeFest 2003 werden zahlreiche antirassistische Initiativen
vertreten sein, unter anderem:

Dies ist lediglich eine Auswahl teilnehmender Initiativen, für die
Antirassimus m.E. ein Schwerpunkt ihrer Arbeit ist.
Die Bunten / Sans Papiers machen neben einem Stand noch eine
Fußballspiel, nach möglichkeit in zusammenarbeit mit anderen Gruppen ein
Turnier. Zeit, teilnehmende Gruppen ect. erst in Vorbereitung.
Am Sonntag gibt es beim Diskussionszelt eine Veranstaltung unter
Teilnahme von Bukasa Di-Tutu und Frau Araba von open-up (angefragt),
Arbeitstitel "für einen neuen Gesellschaftsvertrag".
Auch das Programm auf der Solibühne stellt nicht nur in seiner Vielfalt
eine Aussage gegen Rassismus dar. Es spielen, lesen, kommentieren:
Marwan Abado & viola Raheb, Pacha Manka, Xalis,
Meka-Ajdinovic-Orchester, Jayasri, Nim Sofyan, DigeGrooveCompany, Son
Danzón.
Die Moderation wird unterschiedliche antirassistische Impulse
beisteuern.

VERFOLGT IN ÖSTERREICH - LESUNG OBIORA OFOEDU
Im Mai 1999 (nach dem Tod von Marcus Omofuma, dem Beamte den Mund zugeklebt
hatten) wurde der Nigerianer Obiora Ofoedu von einem Dutzend
schwerbewaffneter Polizisten verhaftet und in Handschellen abgeführt. Der
Innenminister feierte den Fahndungserfolg, erzielt durch den ersten
High-Tech-Lauschangriff der 2. Republik. Doch die Verurteilung als
"Drogenboss von Europa erwies sich als haltlos. Der Eingekerkerte entpuppte
sich als angesehener Intellektueller und Lyriker. In seinem Buch
Morgengrauen berichtet der erste Afrikaner, der in den österr. PEN-Club
aufgenommen wurde, von Polizeiwillkür und menschenverachtender Medienjustiz
: ein bedrückendes Zeugnis von Rassismus und Fremdenfeindlichkeit infolge
tiefwurzelnder Vorurteile.

"AKTION GEMEINDEBAU"Ich möchte Sie gerne über ein Projekt informieren , das derzeit unter
Mitarbeit von Künstlern , für eine Gemeindebau-Anlage in Wien (genaue
Adresse : Hoffingergasse 5/ 1120 Wien) geplant wird.Wir planen für Freitag , den 12. September dieses Jahres ein Aktion
zum Thema "Fremdenfeindlichkeit" . Die Grundidee entstand im Zuge
des Unterschriftensammelns zur "Existenzsicherung für Flüchtlinge"
und der damit verbundenen Problematik (Vorurteile , Entfernen der
Listen , ....).
Deshalb möchten wir im Rahmen einer kunstpolitischen Aktion , unserer
sozialen Verantwortung nachkommen. Das bedeutet in dem Fall , Auf-
klärungsarbeit zu leisten:
Es ist notwendig , Akzeptanz für Neues und Fremdes zu schaffen , durch
gemeisames Besammensein , soll Raum für Gespräche und Diskussions-
runden ermöglicht werden.

Kurzfassung: Bei der Ankunft von Cheibani Wague in Nouakchott waren ca. 100
Verwandte und weitereunzählige FreundInnen und NachbarInnen versammelt. Die
Presse berichtet nicht darüber. Der Fall wird aber per Internet diskutiert.
Je vais répondre en français. Toute la tribu veut dire
tous les cousins au premier, second et 10è degré.
C'est à dire tous les parents au sens africain du
terme, ce qui a correspondu ,au niveau de Nouakchott à
près de cent personnes, sans parler des voisins,
connaissances et amis.
Il n'y a pas eu d'échos dans la presse locale mais
l'affaire a été développée sur les sites qui parlent
de la Mauritanie sur le net.

Dear Minister,
Amnesty International has learned of the death in police custody of a
33-year-old Mauritanian national, Cheibani Wague, in Vienna in the night of
15-16 July 2003 and is informed that several police and medical officials
are being investigated by Vienna Public Prosecutor's Office on the grounds
of negligent homicide. We are extremely concerned about allegations that
Cheibani Wague may have died as a result of his ill-treatment by police
officers and medical personnel and that he may have been arbitrarily
deprived of his right to life. We therefore urge you to ensure that the
investigation into the death of Cheibani Wague proceeds in accordance with
international human rights standards (see below).
According to various reports in the Austrian news media, police were called
to the Afrika-Kulturdorf cultural centre in Vienna's Stadtpark at around
12.40am on 16 July. Cheibani Wague, who worked at the centre as a guide and
a night watchman, had been involved in a dispute with his employer, Erfried
Malle. The dispute between the two men had allegedly degenerated into a
physical altercation. Reports in the Austrian news media indicated that
Cheibani Wague may have been suffering from mental health difficulties at
the time.
The news magazine Profil reported in a 28 July 2003 edition that Cheibani
Wague initially reacted calmly to the presence of the police and ambulance
personnel. According to the head of Vienna's ambulance service, Alfred Kaff,
Cheibani Wague had not acted wildly and had not attacked any of the police
officers, as other media reports suggested. Alfred Kaff also stated in the
article in Profil that Cheibani Wague was communicative and cooperative and
voluntarily stepped into an ambulance, where he was handcuffed and strapped
into a stretcher. However, he was later said to have suddenly stood up and
then ran out of the ambulance, knocking over a police officer in doing so,
before being violently restrained by police officers.
News reports indicated that Cheibani Wague resisted the police officers'
attempts to restrain him in order to place him in the ambulance. However,
the response of the police officers to Cheibani Wague appeared
disproportionate. They were alleged to have forcefully pinned Cheibani
Wague's face against the ground, causing his nose and mouth to bleed. The
head of Afrika-Kulturdorf, Erfried Malle, alleged that police officers then
began to hit Cheibani Wague when he struggled against them on the ground.
Erfried Malle was quoted in several newspapers and news magazines, including
der Standard, Falter and Profil, that one police officer punched Cheibani
Wague at least twice on the back of the head, while another police officer
hit him on his back five times. Shortly afterwards, Cheibani Wague was
reportedly sedated by medical personnel.
Amnesty International is also concerned about the manner in which Cheibani
Wague was reportedly restrained by police and medical personnel thereafter.
You will be aware that video footage, which was taken by a local resident,
has emerged showing a police officer and a medical attendant standing on
Cheibani Wague as he lay handcuffed, face-down on the ground. At the time he
was apparently unconscious. One particular frame of the video footage
depicts six police and medical officials surrounding Cheibani Wague, a
police officer among whom is standing on the detainee's leg with one foot,
while a medical attendant is standing on the detainee with both feet.
Disturbingly, the video footage also shows a doctor apparently watching
Cheibani Wague being treated in this manner. According to various news
reports, Cheibani Wague was restrained in this manner for approximately
seven minutes until medical personnel placed him in an ambulance. The doctor
allegedly only then attempted to revive Cheibani Wague. Cheibani Wague was
subsequently taken to Vienna's General Hospital, where he died at around 6am
on 16 July 2003. Amnesty International is informed that the medical team
involved in the incident were suspended from duty shortly after the video
footage came to light. No such sanctions, however, have been taken against
the police officers.
In the light of the serious allegations, referred to above, Amnesty
International is concerned that the allegedly violent and inappropriate
conduct of the police and medical personnel may have resulted in Cheibani
Wague's death and that he may have been arbitrarily deprived of his right to
life. We are informed that forensic experts are currently examining the
deceased to establish a cause of death. You will recall that the right to
life is guaranteed by international human rights law including Article 2 of
the European Convention on Human Rights and Fundamental Freedoms which
states in particular: "Everyone's right to life shall be protected by law."
Article 2 also stipulates that the force used must be "no more than
absolutely necessary." The right is also enshrined in Article 6 of the
International Covenant on Civil and Political Rights (ICCPR), which states:
"Every human being has the inherent right to life. This right shall be
protected by law. No one shall be arbitrarily deprived of his life." The
Human Rights Committee also noted in its General Comment on Article 6: "The
deprivation of life by the authorities of the state is a matter of the
utmost gravity."
According to international human rights law and standards, all deaths in
custody should be investigated by a judicial or other competent authority to
determine the cause of death. Thus, "a prompt, thorough and impartial
investigation" is a requirement under the United Nations Principles on the
Effective Prevention and Investigation of Extra-Legal, Arbitrary and Summary
Executions, which apply also to situations where death results from
"excessive or illegal use of force by a public official". These Principles
additionally stipulate that: "Families of the deceased and their legal
representatives shall be informed of, and have access to, any hearing as
well as to all information relevant to the investigation ...". Importantly,
Principle 11 of this human rights standard requires that governments "pursue
investigations through an independent commission of inquiry or similar
procedure" in cases in which investigations are deemed inadequate due to
lack of expertise or impartiality, the importance of the matter or the
apparent existence of a pattern of abuse, and in cases "where there are
complaints from the family of the victim about these inadequacies or other
substantive reasons." Investigations should also be transparent, as required
by Principle 16 which states: "A written report shall be made within a
reasonable period of time on the methods and findings of such
investigations. The report shall be made public immediately and shall
include the scope of the inquiry, procedures and methods used to evaluate
the evidence as well as conclusions and recommendations based on findings of
fact and on applicable law."
It is notable that the European Court on Human Rights has also outlined the
essential features of an investigation under Article 2 of the European
Convention on Human Rights, guaranteeing the right to life. The Court ruled
in a case decided in May 2001 regarding a disputed killing in Northern
Ireland that an investigation must be independent, effective, reasonably
prompt, capable of public scrutiny, and capable of involving the next of kin
of the deceased to the appropriate extent.
Amnesty International therefore urges you to ensure that the current
investigation into the death of Cheibani Wague encompasses those features,
referred to above, deemed to be essential under international human rights
law for an investigation under Article 2 of the European Convention on Human
Rights and Fundamental Freedoms and Article 6 of the ICCPR. We also request
to be informed of its findings.
We look forward to your response to the points raised in this letter, a copy
of which is being sent to the Minister of Justice, Dieter Böhmdorfer, for
his information.

Ad 4) Dank an Maria Vassilakou! Ohne das Einsehen von Frau Kossina wäre
diese Sache aber nicht durchsetzbar gewesen. - Ende gut alles gut?
Kossina zu Afrikadorf: Verursacher nicht Betreiber muss zahlen
Wien (OTS) - "Es werde keine Rechnung an den Betreiber des
Afrikadorfes geben", betonte Umweltstadträtin DI Isabella Kossina am
Montag. Das Wiener Stadtgartenamt sei zwar verpflichtet auf Grund des
entstandenen Schadens im Stadtpark eine Rechung zu stellen. Da der
Verursacher jedoch nicht bekannt ist, gebe es nur die Möglichkeit
eine Anzeige gegen Anonym zu stellen und die Rechnung so lange
vorzubehalten, bis der Täter habhaft gemacht worden ist. Die
voreilige Aktion des Stadtgartenamtes, die Rechnung an den Betreiber
des Afrikadorfes zu schicken, beruht auf einer Fehlinterpretation des

Grüne/Brand im Afrikadorf: Vassilakou freut sich über Meinungsumschwung bei
Umweltstadträtin Kossina
Utl.: Nach Kritik der Wiener Grünen zieht Umweltstadträtin Kossina die
Schadenersatzforderung zurück.
Wien (Grüne) - Nachdem die Grüne Stadträtin Maria Vassilakou gestern in
einer Aussendung einen groben "Mangel an Sensibilität bei Umweltstadträtin
Kossina" im Zusammenhang mit der Schadenersatzforderung des Stadtgartenamtes
konstatierte, zog Umweltstadträtin Kossina diese sodann zurück. Vassilakou:
"Es freut mich, dass Fr. Kossina sehr wohl den Unterschied zwischen Täter
und Opfer ausmachen kann. Es ist eine erfreuliche und nachvollziehbare
Richtigstellung", so Vassilakou.
Dennoch bekräftigen die Grünen weiterhin die Forderung an Bürgermeister
Häupl, der Initiative Afrikadorf Finanzmittel zur Verfügung zu stellen.

Mag. Walter Posch lud am 6. Aug. 03 zu einer Pressekonferenz um 11:00.
Sicher anwesend waren Kurier, die Bunten und ORF.
Mag., Posch, sein Referat enthielt folgende Punkte
1. Antidikriminierungsgesetz
2. Asylgesetz
3. Befremdliche Amtshandlungen
Ad 1) Die EU-Richtlinien, ohnehin allgemein gehalten, sehen vor, dass das
Antidiskriminierungsgesetz von den Mitgliedsstaaten bis 15. Juli
verabschiedet wird. Dieses Gesetz ist noch in der Entwurfsphase. In Kenntnis
des vorliegenden Entwurfs bemängelt Posch, dass es vorsieht, dass die
Beweislast bei den KlägerInnen liegt. Beweisführende haben folglich mit
hohen Kosten und Erfolgsrisiko die Klage zu führen.
Es enthält nicht die Möglichkeit für NGO's Verbandsklagen einzureichen. In
terminologischer Weise sind Randgruppen nicht definiert. Religiöse und
weltanschauliche Aspekte fehlen zur Gänze in der Definition der von
Diskriminierung Betroffenen.
NGO's müßten in die Gesetzesbildung eingebunden sein. Posch erinnert, dass
die NGO's, die Vorschläge zum Antidiskriminierungsgesetz einbrachten mit dem
Kreisky-Preis bedacht wurden. Diese Vorschläge sind nunmehr nicht mehr
berücksichtigt.
Posch fordert vor allem eineN Ombudsfrau/mann, die Verstöße gegen
Diskriminierung ahnden. Vergleichsweise ist dieses im
Gleichbehandlungsgesetz vorgesehen.
Posch kritisiert auch, dass die EU-Richtlinien zur Verabschiedung eines
Antidiskriminierungsgesetzes zum Großteil in das Gleichbehandlungsgesetz
eingeflossen sind. Er bezweifelt, dass Ungleichbehandlungen auf Grund der
Geschlechtszugehörigkeit einfach mit Diskriminierungen auf Grund anderer
Zugehörigkeiten in einer Gesetzesmaterie vermengt werden können.
Auf Anfragen erläuterte Posch, dass er sich dafür einsetzt, dass das
Antidiskriminierungsgesetz Auswirkungen auf andere Gesetze hat. Darunter:
Arbeitsrecht (Entlohnung), Wohnrecht, Dienstleistungsgesetz (sehr wichtig
ist der gleiche Zugang zu Dienstleistungen für alle), Schutz vor
rassistischen Beleidigungen (es gibt einen Verhetzungsparagraphen, der
jedoch kaum geahndet wird), Privatrecht (in den USA sind die Privatrechte
effizient antidiskriminierend geregelt).
Ad 2) Am 11. Sept. 03 wird es im Rennerinstitut eine internationale Enquette
zur Asylpraxis in den EU-Ländern geben. Es bestehen unterschiedliche
Standards in EU-Ländern. Es ist zu bedenken, dass 1998 13.000 Asylwerber zu
bebeurteilen waren, 2002 jedoch schon 37000. Posch schließt daraus, dass die
Resourcenmängel der Behörden erheblich seien. Derzeit erhalten die
Privatfirmen, die AsylwerberInnen betreuen 0,82 Euro pro Person und Tag. Die
NGO's egal ob Caritas, Diakonie, Integrationshaus u.a. verfügen über
effizientere Ressourcen. Es ist auch zu erwähnen, dass 700 Personen [2002 ?]
positiv beschieden wurden.
3) Befremdliche Amtshandlungen. Mag. Posch bezweifelt, dass die Exekutive
den nötigen personellen Rückhalt habe, um in der nötigen Streßfreiheit zu
agieren. Überlastungen sind oft Ursache für Fehlverhalten. Auf Sanität und
Exekutive lastet großer Druck. In Österreich fehlen klare Richtlinien für
korrektes und zu vermeidendes Verhalten (etwa im Unterschied zur BRD). Mag.
Posch fordert deshalb Rahmenbedingungen für die Handlungsweise von Sanität
und Exekutive.
Abschließend kommentiert Mag. Posch das Verhältnis der SPÖ zur FPÖ. Es
besteht Konsens in der SPÖ, dass mit der FPÖ in dieser Form die
Vranitzky-Linie fortgesetzt werde.
Publikumsfragen: a) Sind befremdliche Amtshandlungen nicht eher ein
qualitatives als ein quantitatives Problem?
b) Wie sieht Mag. Posch die mediale Verknüpfung von Drogendealern und
Afrikanern.?
c) Wie sieht die SPÖ die Effizienz des Menschenrechtsbeirats.
d) Welche Maßnahmen werden ergriffen, um den Fortbestand des Afrika-Dorfs zu
schützen, vor allem gegen Brandanschläge?
ad a) Was das Qualitative betrifft, liegt ein Bewußtseinsproblem vor. Ihm
ist im Sinne der Aufklärung zu begegnen. Das bedeutet, dass Betreuung und
Ausbildung der Exekutive das Bewußtsein schaffen müssen, damit auch in
Stress-Situationen Handlungen vermieden werden, die in einem derart
katastrophalen Bild enden, wie die Amtshandlung im Stadtpark.
Mag. Posch kann sich Richtlinien wie in der BRD vorstellen.
ad b) Ein Antidiskriminierungsgesetz sollte Verbandsklagen ermöglichen. Das
Strafgestz kennt die Verhetzung. Dieser Paragraph wird jedoch selten
angewandt. Mag. Posch bejaht die Zwischenfrage ob er sich eine Erweiterung
des Persönlichkeitsschutzes im Mediengesetz auf Kollektivschutz vorstellen
kann. Wesentlich ist ihm die Errichtung einer Ombudsstelle, die über eine
rechtliche Handhabe verfügt.
ad c) Der Menschenrechtbeirat ist die derzeit einzige Institution, die
Menschenrechtsverletzungen feststellen kann. Die VertreterInnen dieser
Institution sind durchaus qualifiziert. Die Frage ist jedoch, welche
rechtliche Mittel diesem Beirat zu Verfügung gestellt werden sollten. Und
welche Voraussetzungen verbessert werden können.
ad d) Mag Posch stellt fest, dass in Österreich lebende AfrikanerInnen ein
steigendes Sicherheitsbedürfnis haben. Die offene Frage nach dem nötigen
Schutz für das Afrika-Kulturdorf wird notiert.
Im Anschluss an die Pressekonferenz lädt Mag. Posch die Anwesenden der
african communities ein, den Dialog mit ihm fortzusetzen.

wird auch heuer wieder stattfinden und die Zukunftswerkstätte bietet am

Nicht nur Zeitungen werden daran gemessen, welche Themen sie aufgreifen
und bearbeiten.
In der heutigen Zeit der Medienkonzentration ist eine non-kommerzielle
Stimme wichtiger denn je, die Berlusconisierung der Medienlandschaft
findet auch bei uns statt!
Von Radio Österreich International bis hin zur Minderheitenredaktion von
„Heimat fremde Heimat„ wird von Seiten des ORF massiv gekürzt und nach
politischen Kriterien umbesetzt, unbequeme Programme werden abgesetzt.
Privatradio ist oft nur der verlängerte Arm kommerzieller
Medienmonopolisten. Und nun wird auch von Seiten der Stadt Wien massiv in
die Medienlandschaft eingegriffen.
Dem freien Radio Orange, das seit 5 Jahren unabhängig und non-kommerziell
agiert, wird die schon zugesagte Basisförderung bis dato verweigert. Das
größte Freie Radio Mitteleuropas mit über 200 Redaktionen steht vor dem
AUS.
Nichtkommerzielle Organe sind meist die einzigen Sprachrohre derer, die
weder eine politische noch eine wirtschaftliche Lobby hinter sich haben.
Im internationalen Vergleich sind Freie Medien in Großstädten längst
Standard.
Doch in Wien wird soeben ein seit 5 Jahren funktionierendes Medium
demontiert.
In bedenklichen Zeiten wie diesen sollte es jedem/jeder kritischen
Journalist/in ein persönliches Anliegen sein ein Zeichen gegen diesen
Trend zu setzten.
Deshalb die Einladung zur Sommersoiree.
Ein Signal der Solidarität der Wiener Straßenzeitung mit den Forderungen
der nichtkommerziellen Medien, ein Zeichen gegen eine neue Form der
kommerziellen Zensur.

Gleichzeitig soll auch die sogenannte Harmonisierung der Pensionen der
Bediensteten des öffentlichen Diensts erfolgen. Doch ob der ÖGB aus seinen
strategischen Fehlern im Frühsommer gelernt hat, ist zu bezweifeln...

Wir erinnern uns: Österreich wurde im Frühjahr von einer Welle von Streiks
und Aktionen überschwemmt. Am Höhepunkt beteiligten sich über eineinviertel
Millionen Menschen in der ganzen Republik daran. Die Großdemo in Wien am 13.
Mai erreichte trotz schlechtesten Wetters eine Beteiligung von ca. 150.000
aus großen Teilen Österreichs angereisten TeilnehmerInnen, die damit
deutlich ihren Unmut über die Pläne der Regierung äußerten. Am 6. Mai und 3.
Juni streikten jeweils große Teile des Nah- und Fernverkehrs sowie eine
Vielzahl von Beschäftigten in mittleren und großen Betrieben. Doch nach dem
letzten Aktionstag am 3. Juni war der Spuk wieder vorbei. Regierung und
KapitalistInnen konnten aufatmen...

Arbeiten bis zum Umfallen verdonnern wollen, bekommen für ihre
Ratschläge nicht nur hohe Honorare aus den Steuergeldern ihrer Opfer,
sie werden auch mit Orden geehrt.
Ich möchte aber in einem Land leben, in dem man nicht Vordenker von
sozialen Einschnitten wie den rührigen Rup feiert, sondern jene

Die Ordensverleihung wurde von Landeshauptfrau Klasnic im Beisein von
Landesrat und ÖAAB-Chef Schützenhöfer vorgenommen. Der Geehrte freute
sich laut Landespressedienst "über den ersten Orden, den ich bekommen
habe".

Cancun Report:Lisa Fithian and Starhawk from RANT went to Mexico from July 27 - August 7th
where we met with organizers and local activists in Cancun and with
campesino organizers in Felipe Carillo Puerto, three hours south. We went
to Mexico City on Aug. 1st and spent the weekend with students at an
encampment focused on the WTO and then attend a three day gathering meeting
of Via Campesino. We also met with lawyers coordinating the legal support
for the September mobilization. Our primary interest was plans for
nonviolent direct action. Here is a quick summary of what we learned:
In Cancun itself:
Cancun is a new city that was created as a tourist center for the Mexican
economy. As such there is no history of social movements or many activist
based organizations. And thus few organizers have much direct action
experience.
The Comite de Bienvenida or the Welcoming Committee in Cancun is focusing on
logistics - finding spaces for camping and the forums as well as food.
They are also working with the global network of NGO's called Our World is
Not for Sale in organizing the forums, fair trade fair, etc. There is more
than enough work for what is basically a small group of people and they have
been having trouble locking down specifics. They are negotiating with the
city but there are only so many places for up to 10,000 people to camp.
Another local Cancun group, more youth and arts is emerging and they are
focused on organizing youth and beginning to do outreach and mobilization in
the local community. They are very interested in bring a cultural component
to the streets in the form of puppets, drum processions and so on. They
have a base that hang in the Parque las Palapas which is the cultural center
of Cancun City
Puente de Cancun is a small group of internationals sponsored by Global
Exchange that is 1) providing info bulletins to the world, 2) organizing the
media convergence and 3) serving as a link to internationals.
We felt that a convergence space for organizing and supporting the street
actions is needed, and Mike, who was working with the Puente, was very, very
helpful to us, and is looking into housing/convergence space. We are
fundraising to help cover the costs and people can make donations to RANT in
order to secure one. More info below.
Two of the students from Mexico City are also going down to Cancun this week
and will be on the ground organizing from now on. They both have a good bit
of direct action experience which is great.
Finally on Cancun - the criminalization campaign has begun. There were
daily articles about foreign instigators, over 200,000 coming, about folks
bringing explosives and so on. The usual. But this all has a chilling
effect. Also two years ago at the WEF protests the police were pretty
brutal so there is a memory of that and some desire on the part of the
Comite not to see direct actions. All of this is evolving however as it is
clear that there are different sectors with different visions and plans…..Students:
The student activists we worked with are great and inspiring and
experienced, sophisticated organizers. Over the weekend encampment, they
formed a new group, Alianza Global S-9/Global Alliance S-9, to be a
coordinating body for all the groups planning street actions particularly on
the 9th.
They came from numerous groups and several cities and have some clear ideas
about what they would like to see happen. While many want to go it is very
expensive since the whole trip will be about 10 days with bus travel and
all. The students are hoping that international activist will contribute
to help reduce the individual cost thereby allowing more to go.
They are writing a letter and where people can send money, but short of that
RANT is also willing to help get money where it needs to go. (Info below)

Campesinos:
Via Campesino and its related Mexican compesino organizations, (UNORCA being
one of the main ones) are planning to mobilize 5-10,000 people. Again,
numbers depend partly on money. They are organizing their own forums on
the 8th and 9th and then planning a day of action on the 10th which is the
opening day of the Ministerial and the day focused on agriculture.
They are planning actions across the hemisphere to disrupt international
commerce as well as a plan to march to the Convention Center to deliver a
declaration. Their intention is to get inside to read it.
They will march on September 10 and probably support whatever actions take
place on September 9 although it seems unlikely that they will take a major
role in them. The student made a proposal to them and they have a big
meeting soon to make a final determination on their plans.

9/10 Ministerial Opens, focus on agriculture. March and possible actions
by Via
Campesino.
Alternative Trade Fair - through the 12th out on the island
9/ 11 Zapatista Encuentro
Dia de la luto‹memorials for victims of war and violence, anniversary of the
coup
in Chile as well as 9-11 in U.S., Street processions, offrendas, cacerolazo
(beating pots and pans‹a South American political tradition), and a Chilean
pena
at night are suggestions.
9/12 Services under discussion at ministerial: suggestion to be in the
streets of Cancun
City offering services to people‹free food, water, medical care, etc.
9/13 Mass March against War and Free Trade.
9/ 14 Ministerial Closes, possible Fiesta on the beaches?
9/15 Mexican Independence DayOther aspects:
Legal: Legal support is being organized by a Mexican human rights
organization. We met with their representatives who seem to have a great
plan. They will aid internationals who have problems with immigration and
provide support for the actions, and they seem to have this base well
covered. A legal Handbook is almost complete that will be translated into
English and put on line on the Comite's webpage.
Medical: Various teams of street medics are coming down from the U.S. and we
believe that this, too, will be well covered.
Housing: Campsites for the major moblizations of campesinos and students
are still being negotiated. We have people looking for houses to rent for
groups of internationals and for a convergence space, but don_t yet have
anything confirmed.
Visas: The Mexican government is requiring a special visa for accredited
journalists and delegates who will be entering the Conference Center area,
but we have been told that unaccredited people should just come on a regular
tourist visa. Passports are required for those flying into Mexico.
Weather - hot, hot, hot, oppressive or rain, rain, rain. Come prepared!
Mosquitos also can be a problem, so some good nontoxic bug juice could come
in handy.
Theft: Theft is a big problem in Cancun and Mexico City. We recommend an
under-your-shirt money belt for your passport and cash and a wary eye when
on busses, the subway, or in crowds. Don't' bring anything of real value or
consider insuring it. The Puente House was just broken into and computer
equipment etc stolen.
There are cheap internet café's everywhere!
What's Needed from Internationals: Being there! Cancun is hard to get to
for a lot of Mexicans, and internationals are needed and welcome in order to
get the numbers we need for a large-scale mobilization. Internationals
present will also change the dynamic with the police the Mexicans believe.
Fundraising: Funding is needed to bring more students and campesinos to
the actions. Anyone who can't come is be encouraged to make as big or as
small a donation as possible. RANT will help get the money to Mexican
student organizations or convergence space.

CALIFORNIA GOVERNOR'S FIASCO
Why should Abolitionists care about who is running in the gubernatorial
recall circus- er, I mean, election - in California? Well, the California
state budget approved by the
assembly not too long ago contains the provision to authorize the $220
million in lease bonds requested by Gray Davis to build a 968-bed death row
on the grounds of San Quentin. This plan for a massive increase in
California's death row population -- already the largest death row in the
nation, and the world -- is unjustifiable and obscene. The entire
legislature should be recalled!
I wrote about Georgy Russell ( http://www.georgyforgov.com/ ) in the last
message. Georgy is the only person running who I am aware has actually
spent time volunteering as an abolitionist, for the abolitionist group
Death Penalty Focus of California (DPF) ( http://www.deathpenalty.org/
). I received a very nice note from Georgy's father, George, who happens
to be a former DPF board member, and a recipient of CUADPUpdate. I also
realize that I opened a can of worms, so to speak. How many other
candidates are abolitionist? CUADPUpdate recipient *AND* CUADP donor Norma
Harrison wanted to make sure Californians know about one other such candidate:
Abe - Peace and Freedom Party has a candidate for governor on the
California ballot , C.T. Weber. He's been with us as long as we've been
here, 35 years - used to be in several other states, too, at various
times. A major call of ours is to abolish the death penalty, along with a
lot of other calls to build societies which obviate crime/criminality - or
address it to tend toward its elimination through rationalizing society,
rather than taking it as a given. Our opposition to the death penalty has
never wavered and has been one of our strongest standards in our socialist

Small-label album takes a stand against the death penalty
Kansas City Star By Timothy Finn
One of the year's best country albums celebrates one of country music's
longest and darkest traditions: the murder ballad.
The album also is tied to one of the most potent political issues in the
country -- capital punishment -- so you know it wasn't made in Nashville by
commercial country stars.
In fact, the album was made by a small label in Chicago and produced by a
Welshman, and neither is the least bit worried about a backlash.
"It's all really a cheap one-liner," said Jon Langford, who produced "The
Executioner's Last Songs: Vol. 2 and 3" for Bloodshot Records. "You know,
death songs against death."
Langford is a folk artist (he did the album's cover art) and a member of no
fewer than four roots-rock or country bands, including the Pine Valley
Cosmonauts, the house band for "Last Songs."
A native of Wales and now a resident of Chicago, he began publicly
associating himself with the anti-capital punishment issue last year, when
Bloodshot released Vol. 1 of "The Executioner's Song," which raised $40,000
for the Illinois Death Penalty Moratorium Project.
In the liner notes to that album, Langford wrote blithely: "Here's a little
historical trawling and purging to aid and support the long, civilizing
march against the death penalty in this earth's richest land."
On the phone he is more direct about his behind-the-scenes support for the
project: "This is a big moral issue for me. I think murder is wrong. I
think it's wrong to kill anyone in a civilized society. I come from a place
that didn't have it. It shocked me how little debate there is about it over
here then. It wasn't an issue. It has become more of one."
Especially in Illinois, where Republican Gov. George Ryan enacted a
moratorium on executions in January 2000 after DNA evidence cleared several
death-row inmates.
"That wasn't why I got behind it," Langford said. "But it became a good way
into the issue for a lot of people -- all the horrific stories: Guys living
for 16 years under the threat of execution for something they didn't do."
The Illinois moratorium made it easier for Langford to line up recruits for
Vol. 2 and 3, including Kansas City's own Rex Hobart, who wrote a song just
for the record.
"I agreed to contribute for no other reason than I think it's a little too
easy to wrongly convict and execute someone," Hobart said this week.
Like many of the songs here, his contribution, the eerie "Forever to Burn,"
is about love and murder. A guy catches his lover with another man and
unrepentantly kills them both: "I can't ask forgiveness," the killer says,
"for what they both deserved."
"The song is basically about a guy who feels sort of trapped between the
institutional laws that surround him and the laws of love," Hobart said.
"It's by no means an excuse to commit murder. It's not a defense of murder.
It's just the other side of the story."
Langford, who covers the Tom Jones' hit "Delilah," agreed that the album
had no political point, musically: "It's not a message album, really," he
said. " `Delilah' is a cartoon song I've been singing since I was 7. Tom
Jones is from Wales. It's a great song -- almost a joke song. But if I were
trying to get a message across with that, I'd have to be demented."
Instead, he said, the record is supposed to be what it is: a collection of
great country songs, old and new, that any country music fan can enjoy.
"The intent was to have one band, the Cosmonauts, playing with guest
vocalists who are singing songs that stick to a rather tenuous theme:
death," Langford said.
"We wanted a proper country album that might even appeal to people who are
pro-death penalty. We really don't care who's money we get."
He succeeded in making a great album. Robert Moore has played several
"Executioner's" songs on his weekly "Sonic Spectrum" show, broadcast from 2
to 4 p.m. Saturdays on KCUR-FM (89.3).
"It's easily one of the best country albums of the year," Moore said. "It
revives a lot of great tunes, and not just the traditional country murder
ballads but also some songs like `Gallows Pole,' a ballad that Led Zeppelin
covered (on `Led Zeppelin III')."
Most of the artists on the album are well-known in the small world of
alternative country -- Bloodshot's bread and butter. A lot of the songs,
however, are just well-known, like "Strange Fruit," "Tom Dooley," "Long
Black Veil" and Roger Miller's "Dang Me."
The music on the album is top-notch, but, as expected, Langford and the
label have received a fair share of angry responses from people who love
the music but object to its political intent.
"We've gotten some pretty harsh e-mails," said Rob Miller, who co-founded
Bloodshot back in the early '90s in part to revive some of the old-time
country music that wasn't coming out of Nashville anymore.
"That was a little surprising because I thought most of the people who
bought our music were of the same mind we are politically."
"It has (angered) a lot of people," Langford said. "But my sense is that

CUADPUpdate recipient and long time supporter Mike Lax writes....
I'm kinda of a nerd so I've gotten into CSI (sexy
scientists - my kind of program). Well, USA Network
just started a sort of old-Western CSI, Peacemakers.
The second episode was a rather interest anti-death
penalty episode. Given that it takes please in the
1890's, I was *kind* of curious how they were gong to
pull it off, but they did a pretty good job. The last
line is what got me - after they keep the innocent
person from being hung (in an automated gallows I'd
never seen before), someone asks about what will
happen with the person who did the crime (that's how
they got the other guy free); the response was "I
don't think the gallows will be going away any time
soon". 100+ years later, and here we are....
If you get USA, the show repeats several times. It's
corny for sure, but a good anti-DP message.

Workman lawyers claim they have proof he was wrongly convicted
By ROB JOHNSON
Staff WriterAttorneys for convicted killer Philip Workman, claiming that they now have
proof that the state's sole eyewitness committed perjury, plan to ask Gov.
Phil Bredesen to commute the inmate's death sentence tomorrow.
For now, attorneys in the federal Public Defender's Office won't comment
on their new evidence, which they plan to unveil tomorrow at a downtown
press conference. There, they promise to produce ''new evidence that
proves once and for all that Philip Workman was convicted and sentenced to
death on the basis of a lie,'' according to a statement from the office.
Workman was convicted in 1982 for the shooting death of Memphis police Lt.
Ronald Oliver. The officer was responding to a holdup alarm at Memphis
fast-food restaurant and encountered the stick-up man - Workman - outside.
Oliver was shot to death, and Workman was immediately arrested.
His case and his conviction landed him on Tennessee's death row, where in
March, 2001, he found himself just hours away from being executed, until
the courts issued a stay.
The state Supreme Court ordered a hearing on the merits of defense
evidence that included challenges to eyewitness testimony and ballistics.
At that hearing, Harold Davis, the state's eyewitness in the 1982 trial,
gave conflicting statements. He said that after 20 years of drug abuse and
health problems, he could no longer remember what he saw or did not see
the night Oliver was killed.
Afterward, Criminal Court Judge John Colton Jr. ruled there was no
reasonable probability that the new evidence would have resulted in a
different verdict.
Now defense attorneys claim, they have conclusive proof that Davis has
perjured himself, and they say will immediately file a clemency request
with Bredesen.
Workman is scheduled to be executed Sept. 24.

Council of Europe welcomes the commuting of 42 death sentences in Armenia
Strasbourg, 02.08.2003 - The Secretary General of the Council of Europe,
Walter Schwimmer, has warmly welcomed the decision of Armenian President
Robert Kocharyan to commute all outstanding death sentences to life
imprisonment.
President Kocharyan reportedly cited Armenia's obligations as a Council of
Europe member state as the reason for reducing the sentences of the 42
prisoners involved.
Mr Schwimmer said: "I am delighted that President Kocharyan has taken such
a positive and commendable step forward. The death penalty is an affront to
all notions of dignity and human rights, and has no place in the Europe of
today.
"This decision is a clear sign that Armenia is determined to honour its
commitments to the Council of Europe, and wants to become fully integrated
within the European family of nations," he added.

NY CITY MAYOR OPPOSES DEATH PENALTY
Mayor Restates Death Penalty Opposition
Reacting to a move for capital punishment in the case against 2 men charged
as cop killers, Mayor Michael Bloomberg yesterday restated his opposition
to the death penalty.
"I've always had problems with it because too many times in the past you've
seen innocent people incarcerated, and tragically, every once in a while
they've been executed," the mayor said.
"Murder is murder, no matter who does it," he said. "I think we as a
society can afford to incarcerate people. Whatever the law is, the law is,
and the DA will deal with the courts and juries and they'll decide."
He added, however, "It's not something that's up to the mayor. The city
government does not have a lot to do with penalties for murder."
Bloomberg, the local host of next year's Republican National Convention,
differs from many party members on the issue.
Former Mayor Ed Koch, a supporter of Bloomberg in recent years, touted his
support for capital punishment in his successful 1977 mayoral bid amid high
crime and the "Son of Sam" serial-killing cases.
Also yesterday, Bloomberg reacted to reports that 65 murders have occurred
in Queens so far this year, compared with 50 at the same time in 2002, by
saying Police Commissioner Ray Kelly is responding.
"He's moving the resources," Bloomberg said. "When you have a spike in any
kind of crime, he moves his resources there. ... As you get lower and lower
crime rates, one murder or robbery starts changing things percentage-wise."

The Northern Illinois University College of Law announces its 13th annual
Law Review Symposium, which will focus this year on "Emerging Issues in
Equal Protection Jurisprudence."
The Symposium will bring together legal scholars and practitioners to
present the most recent understandings of how the legal systems of the
United States address the critical social issue of equal protection. The
Symposium's goal is to highlight the manner in which legal systems both
fulfill their roles in responding to equal protection violations as well as
fail to fulfill these roles.
The Northern Illinois University Law Review is an academic legal journal
devoted to discourse on legal issues of public concern. The summer 2004
issue will be devoted to papers submitted for the production of the 13th
annual Symposium. Non-traditional journal articles, such as essays,
letters, and book notes will be considered for publication as well.
The Law Review Symposium Editor announces a call for papers for this issue.

Never again in your lifetime will the Red Planet be so spectacular!
This month and next, Earth is catching up with Mars, an encounter that
will culminate in the closest approach between the two planets in
recorded history.
The next time Mars may come this close is in 2287. Due to the way Jupiter's
gravity tugs on Mars and perturbs its orbit, astronomers can only be
certain that Mars has not come this close to Earth in the last 5,000 years
but it may be as long as 60,000 years.
On August 27, Mars will come within 34,649,589 miles and will be (next to
the moon) the brightest object in the night sky. It will attain a magnitude
of -2.9 and will appear 25.11 arc seconds wide. At a modest 75-power
magnifiction
Mars will look as large as the full moon to the naked eye.
Mars will be easy to spot. At the beginning of August, Mars will rise in
the east at 10 p.m. and reach its azimuth at about 3 a.m. But by the end of
August when the two planets are closest, Mars will rise at nightfall and
reach its highest point in the sky at 12:30 a.m. That's pretty convenient
when it comes to seeing something that no human has seen in recorded history.
So mark your calendar at the beginning of August to see Mars grow
progressively brighter and brighter throughout the month.
Share with your friends, children and grandchildren. No one alive today
will ever see this again!

Abe: Yes, on Aug. 27 Mars will be the nearest in human history, and it will
appear 25.11 seconds of arc wide. This is the nearest and largest since
57,617 BC, when it was 25.13" wide, and until AD 2287, when it will be
25.14" wide. Mind you, the difference is rather slight: Mars is at
opposition about each 2.13 years, and roughly each seventh of these
oppositions is a good one.
ALSO - and this is for TONIGHT:
The great meteor shower in August is the Perseids, this year expected to
climax about midnight between Aug. 12 and 13 (by eastern US time), which
unfortunately is during the Full Moon. The Perseids, also called "St.
Laurence's Tears" because of the death-penalty against that martyr (he was
executed on a hot griddle), are the reason why meteors were often
associated in the public mind, e.g. that of poets, with the late summer.
